DOWN TO EARTH RETREATS – Terms and Conditions
By paying a deposit for our retreats, you are agreeing to the following ‘Terms and Conditions’:
1: Booking
Details of deposits/payments::
- A non-refundable, non-transferrable £250 deposit is needed to secure your booking.
- The balance, also non-refundable and non-transferrable, is due eight weeks before the start of the retreat.
- You can also choose to pay the total amount to confirm your place.
Once a deposit has been paid, a request to pay the full balance will be sent nine weeks before the retreat. If the balance is not paid eight weeks prior to the start of the retreat, we reserve the right to cancel your place, retain your payments and apply the cancellation charges explained in Section 3.
For bookings made within eight weeks of the start of the retreat, full payment is due on confirmation of the booking. Once payment has been made, any cancellation will incur cancellation charges as explained in Section 3.
Your booking is definite, and a contract exists between you and Down To Earth, only when we confirm receipt of your deposit. No contract will exist between us prior to the confirmation email being sent.
2: Cancellation or postponement by Down To Earth
It is highly unlikely that we would postpone or cancel a retreat; we would only do so as a last resort. However, if a cancellation or postponement is needed, Down To Earth reserves the right to do so at any time before the start of the retreat. If we do, we will offer a full refund. You may also be able to transfer your payment to another retreat.
Compensation will not be paid if Down To Earth is forced to cancel or change the retreat due to force majeure.
Down To Earth is not responsible for anything you may have paid for travel, so please book flexible travel tickets that allow free date changes or that issues credit vouchers for future travel.
3: Cancellation by you
You can cancel your place on the retreat at any time, but the cancellation must be made by the person who made the booking and sent via email to [email protected]. Cancellation will take effect the day that notification is received by us.
If you cancel your retreat place, we will retain your deposit. Cancellation charges will apply, and these are:
- 8 weeks or more before the start of the retreat: Deposit only
- 4-8 weeks before the start of the retreat: 75% of full amount
- Less than 4 weeks before the start of the retreat: 100% of the full amount
If you are no longer able to attend the retreat, we might be able to move your booking to another retreat, provided we can re-sell your place. This is only possible if you let us know at least four weeks before the retreat starts and is dependent on whether we can re-sell your place. If we can’t, our cancellation charges will apply.
Once your retreat begins, no refund or part-refund for the unused remainder of the retreat will be repaid if you leave/cancel. However, if your reason for cancellation is covered under the terms of your travel insurance policy, you may be able to reclaim these charges from your insurance company..
4: Acknowledgement of risk and indemnity
It is your responsibility to buy travel insurance that covers all aspects of the retreat and your travel.
It is your responsibility to ensure you are capable of undergoing the exercise, postures and activities on offer during the retreat. There is risk of injury and you are advised to consult a doctor prior to booking the retreat, if necessary. We are not able to give you medical advice.
You are partaking in all activities on the retreat, whether they are organised by Down To Earth or not, voluntarily and in the knowledge of any risks.
Down to Earth accepts no liability for loss or damage to your property or for injury, insofar as such loss, damage or injury is by law incapable of exclusion.
You agree that neither you, nor your heirs, assigns or legal representatives will sue or make any other claim of any kind against Down To Earth or any of its employees/teachers in respect of any loss or damage that may be suffered. This is the case whether it is a result of negligence or otherwise, save only to the extent that liability in respect of such loss or damage may not be excluded or limited by law.
5: Your health
If you have any concerns about your physical or mental health then you must seek medical advice from a doctor who has an understanding of yoga/Pilates before booking this retreat.
It is your responsibility to inform us of any injuries or physical/mental health conditions (including pregnancy) prior to the retreat. You must add these details to the Information Form before you complete your booking or, in the event of new information arising nearer to the start of the retreat, please email us as soon as possible.
We reserve the right to refuse access to anyone if we consider that the health or wellbeing of the individual, or others, may be endangered by use of the facilities or participation with activities on the retreat.
6: Food allergies and dietary requests
If you have any food allergies or dietary requests, you must contact us in writing (using our Information Form) before you complete your booking to ensure we can meet your needs on the retreat.
If you have not received written confirmation from us that we can meet your dietary requests, and you are unable to eat from the menu offered, we will not be able to offer alternatives. If you choose to not attend, or continue with, the retreat in this circumstance then no refund will be given and you are responsible for any costs for early departure.
- Photos and videos
We will take photos and videos during the retreat, and these might be used for promotional purposes, eg. on social media and Down To Earth’s website or newsletter, etc . You understand that you might appear in these photos or videos, and you agree to them being used by Down To Earth in the future. You can talk to a member of our team if you have any questions/comments about this during the retreat.
8: Group conduct
If a member of our team believes that you are acting in a way that is inappropriate towards other people, you will be requested to stop. If the inappropriate behaviour continues, we may ask you to leave the retreat.
Inappropriate behaviour includes verbal abuse, aggressive behaviour and violence, repeatedly disruptive behaviour, consuming excessive alcohol or drugs and sexual harassment (including sexual comments and unwanted touching). It also includes unwelcome behaviour that intimidates, offends or humiliates a person because of a characteristic such as age, race, gender, disability, religion or sexuality. It also includes culturally disrespectful or insensitive behaviour.
If you are asked to leave due to your inappropriate behaviour, no refund will be given and you are responsible for all costs that result from your early departure..
We kindly ask you to treat the retreat property with care and respect. We also recognise that accidents can occur, and request that any damage caused to the property be reported promptly. Additional charges may apply to cover the necessary repairs or replacements.
9: Retreat prices
Our retreat prices include accommodation, all meals and snacks as advertised, all group yoga/Pilates classes and any listed excursions, unless stated differently in your booking confirmation.
Our retreat prices exclude travel costs, travel insurance, tips, optional excursions/massages and transfers from train stations, unless otherwise stated.
10: Complaints
If you have a complaint during the retreat, please inform a member of our team immediately, and they will try to sort things out. If your complaint cannot be resolved during the retreat, you must let us know in writing immediately upon your return.
11: The contract
This contract is made on the terms of these booking conditions. These are governed by English and Welsh law, and the exclusive jurisdiction of the English and Welsh Courts.
